Are you planning to open a business in Mission Viejo, California?

Mission Viejo, California is unique in that they do not require a person planning to open a business to obtain a business license. They do, however, require each business to have a Certificate of Occupancy. You can request a certificate of occupancy application from the City of Mission Viejo Community Development Department. You will need to obtain zone approval for your business location prior to signing any leases or entering into any real estate contracts. What information will be needed for a Mission Viejo Certificate of Occupancy?

If you do not plan to do any type of tenant improvements, you will need to submit the following information to obtain your Mission Viejo Certificate of Occupancy:

  1. A completed application
  2. A fee of $217.00
  3. A letter containing your name, and a brief description of your business, square footage of tenant space, differentiation of the storage from the office space, or a note that only the business name and/or owner’s name is changing
  4. A copy of the floor plan of your business location
  5. A site plan complete with entire lot of building and your business location within the building
  6. If you are opening an automotive shop, you need to submit electrical and mechanical plans
  7. Planning division approval
  8. Inspection from building inspector

If you plan to make changes to the building you are leasing or buying, you will need to provide information on a tenant improvement application. This application requests information about your business location, your business activities and all contact information for your business as well as contact information for the business owner. Other information is specific to your business location, such as the name and contact information of the property owner, the construction type, the occupancy load and code, the square footage, number of parking spaces, number of employees who will be present during the largest shift and whether there are fire sprinklers installed. If you will be doing any tenant improvements, you will need to submit information on the type of improvements, the name and contact information of the contractor who will be doing the work, square footage of the area being improved, and a detailed list of the work that will be being done. Please note that any tenant improvement may require a building permit.

Not requiring a business license from the City of Mission Viejo in no way relieves potential businesses from federal, state, and/or local requirements. If you wish to operate a Mission Viejo home based business, you will need to need to be familiar with the city’s zoning regulations which will outline the restrictions and requirements for anyone wishing to use their home for a business base. You can contact the Community Development Department to discuss these regulations and to determine if your business activities will meet the requirements for a home-based business. As a home-based business, you will not be permitted to create any noise, traffic, or in any way impact your neighborhood more than any residential activity. You will only be permitted to use the interior of your home for business activities and will not be permitted to employ anyone outside of your home to work in your business.
