Will I need to license or register my business in Montana?

While starting a business in Montana, it is best to contact the Secretary of State first. They can help you identifying the forms and information needed to apply for either state or federal licenses. Not all business in Montana will require a “general” business license. Only certain business are required to register with the state. For example, if you are a Sole Proprietorship and plan on doing business under your own name, you don’t need to register with the Secretary of State. However, you must apply for and obtain the necessary state and local business licenses.

Do I need a license with my local city or county?

Businesses may need to apply for a business license at the city or county level. Some professions in Montana, such as dentists, barbers or chiropractors also need a specialty license. Contact the Professional and Occupational Licensing Bureau of the State Department of Labor and Industry at 406-841-2300 to find out what licensing you may need.

Every city and county may have different requirements when operating a business in city limits. Contact your local city or county either online or by phone to know what requirements exist. For example, the city of Missoula has a business license application (available online!). However, the city of Great Falls does not issue business licenses to businesses located within their city limits.

What other requirements are needed for operating in Montana?

Some other requirements by the state may be applying for a Federal State Tax Identification number (EIN), and registering your business name through the State. Businesses with employees must register for insurance, taxes, workers compensation, etc. You may also need to register your business entity with the Secretary of State (type of business, such as corporation, limited partnership).
