Do
I need a business license for West Virginia?
Many businesses in West Virginia will need to obtain
a business license in order to operate, but there
is no one license that all businesses must have. Whether
your business needs a license is based on the type
of activities you plan to carry out. West Virginia
requires regulatory licenses for dozens of different
business activities as well as occupational licenses
for professions that are overseen by state agencies
and licensing boards. However, even if your business
does not require a license from the state, you may
need to get a business license from your local municipality.
Are there any other state requirements besides
licensing?
Yes, all business types must register with the State
Tax Department. In addition, all business types except
for general partnerships and sole proprietors must
register with the West Virginia Department of State.
While general partnerships are not required to register,
it is recommended that they register with the Department
of State and any county where they own real property.
You should register with the State Tax Department
before filing your paperwork with the Department of
State. Most of this can now be done online at www.business4wv.com.

Are there any local licensing requirements?
Local requirements for business licensing depend
on the location where you are operating your business.
Many cities in West Virginia do require that all businesses
obtain a general business license from the city prior
to opening. Some cities such as Huntington also require
that the business register with the local government,
which is a separate process from applying for a business
license.
In addition to general permits, local municipalities
may require your business to get special permits based
on your location or business activities. Also, if
you plan on running your business out of a home office,
then some cities such as Wheeling and Huntington require
that you obtain a home occupancy permit prior to starting.
What information will I need to provide on
my license application?
The type of information requested will depend on
the license you are applying for, but generally you
will be asked to provide:
- Name of business
- Address and contact information of business
- Owner's name and contact information
- Date of start of business
- Type of business (corporation, LLC, sole proprietor,
etc.)
- Nature of business activities
You may also need to provide information and documentation
regarding your state registration, if applicable.
Many applications also request your Federal Employer
Identification Number (EIN) available from the IRS,
or your social security number if your business does
not have an EIN.
