If I plan to open a new business in Anaheim, do I need a license?

Yes, the city law of Anaheim expressly states that no one is to engage in any type of trade or business with out first being granted a license. There are very few exceptions to this law, and if you feel that your business may be exempt, you must contact the Business License Division at (714) 765-5194 to inquire about it. How do I apply for my business license?

The first step in the application process is to contact the Business License Division between 8:00 a.m. and 5:00 p.m. Monday through Friday to let them know what type of business you are planning to open. It is important to note that you will likely need some permits to operate your business, these must be in place before your business opens, so while you are inquiring about other license requirements may be a good time to ask about additional permits as well.

The next step is to contact the Planning Department at (714) 765-5139, where they will answer questions related to zoning requirements. During your initial call to the Business License Division, you can request that they mail, fax or e-mail you a business license application. Once you receive your application, you will need to fill it out completely, describing in detail the business you plan to open. You are required to indicate whether you are opening a new business, renaming an established business, a change of ownership, or address change. You must also state who owns the business, if you are the sole proprietor, if it is a partnership, or a part of a corporation.

If your business is home-based, you will still need to have a business license, but additionally, you will be required to procure a Home Occupation Permit. You can obtain this from the Planning Department, they will then review the type of business you wish to conduct to be sure that it is acceptable within your residential area.

What fees are required for my business license?

A fee is required for processing your initial or renewed license application. This non-refundable fee is in addition to the business license tax, a home occupation permit fee and any other fees that will be added to your licensing process.You can find information about fees on the City of Anaheim website.

What is the process for renewing my business license?

If you have been given your license, it is valid for one year. Thirty days before it expires, you should receive an automatic renewal notice. If you do not receive it, you are still responsible for the business license, so you must contact the Business License Office to renew.

If you do not renew your license, you will be penalized 10% or $10.00 (whichever is greater) per month, and additionally, a one-half percent will be calculated from the first day of becoming delinquent until a payment is made.

If you sell your business, the new owner is required to apply for their own license. The existing license cannot be transferred to a new owner and is invalid after the sell of your business.

If you are changing the location of your business, you will need to alert the Business License office of the change by contacting them at (714) 765-5194. You should request an application for address change. There is a fee for this if your license is up to date. If you change the name of your business, again, contact the Business License office and notify them and request a business name change application. There is a processing fee if the business license is current.

What other information do I need to know?

• You should note that your business license must be displayed at your business location. If you do not have a physical address (such as if you are a street vendor) you must carry your license on your person while doing business.
• Certain businesses will have to be approved by the Police Department before licensure is approved, these could include, but are not limited to: security and guard services, massage technicians or establishments, adult bookstores, pawnshops, fortune telling, alcoholic beverage sales, sex-orientated businesses, peddlers and solicitors.
