Where do I get a marriage license in New York state?

If you are wondering where to get a marriage license in New York, you can apply for a New York marriage license at any City or Town Clerk’s office in New York. The marriage license in New York is good throughout the state for 60 days and does not have to be used in the municipality that issued the license. For example, you and your fiance can apply for a NY marriage license in your hometown of Albany and use it for your wedding in Brooklyn a month later. However, marriage licenses from other states are not valid for weddings taking place in New York so out of state residents that are planning on a marriage in New York must make the time to apply for and receive a New York marriage license to be legally married there. What is the process for getting a New York marriage license?

In order to receive your New York marriage license, you and your fiance must appear together at the City Clerk’s office to file the application and present proof of age and identity. Acceptable ID must usually include a photograph and be government issued; the most common forms of proof are a driver’s license or passport. Some cities and towns may require additional proof of identification, such as a certified birth certificate. Once you file the application and pay the license fee, the license will be issued immediately but is not valid until 24 hours after it is issued. Some cities such as New York City have an online marriage license application system where you can complete and submit the bulk of the application over the internet. However even when this service is available, you and your fiance will need to go to the New York City Clerk’s office together to finalize and sign the application before the license will be issued.

Are there special New York marriage requirements if this is not my first marriage?

In order to be married in New York, you must not be currently married to someone else. Therefore, it is very important that you are sure your final marriage is officially dissolved. Some municipalities may require that you prove this by presenting certified copies of your final divorce decree, annulment papers, or the death certificate of your former spouse. It is best to check with the City Clerk’s office where you will be applying to see if any additional documentation is needed.

How much does a marriage license New York cost?

Marriage licenses issued in New York State but outside of New York City cost $40. Currently, licenses issued by the New York City Clerk’s office cost $35. Outside of New York City, certified copies of the license or final marriage certificate can be obtained from the municipality that issued your marriage license or from the New York Department of Health for a small fee. If your license was issued by the New York City Clerk’s Office, then they can provide you with certified copies of your marriage license.
